The National Consultative Commission of Collective Agreements (CCNCC) is a collegiate, tripartite body, in which the General Administration of the State and the most representative trade union organizations and business associations are represented, having an autonomous action in their functions, although, from the organic point of view, it is attached to the General Directorate of Labor, of the Ministry of Labor and Social Economy, in accordance with Royal Decree 499/2020, of April 28 (BOE of May 1, 2020), by which the basic organic structure of the Ministry of Labor and Social Economy is regulated,
The CCNCC can operate in plenary and in the Standing Committee. Normally, the Commission functions as a Standing Committee, although the Standing Committee itself may reserve for the Plenary the approval of certain opinions, reports and decisions.
The Plenary is composed of the President and all the members representing the General Administration of the State and the most representative business and trade union organizations, as well as its Secretary. The current President, D. Jesús Cruz Villalón, was appointed by the Minister of Labour, Migration and Social Security (BOE of November 20, 2018 ), after consulting the most representative business and trade union organizations, among professionals of recognized prestige in the field of labor relations.
The tripartite composition of this Commission results in the integration into it of six representatives of the General Administration of the State, six of the most representative trade union organizations and six of the most representative business associations. For each group of representation, the same number of alternate members is designated to replace the incumbent members in the event of vacancy, illness or absence. The Secretary of the Commission acts as an official attached to its administrative services.
The Standing Committee is composed of the Chairman of the Committee and two members from each of the three constituent groups, as well as its Secretary. The appointment of the members of the Commission is the responsibility of the plenary session of the Commission, on the binding proposal of each of the representative groups. Its composition responds to what was agreed in this regard at the meeting of the 151 plenary session, held on 14 October 2012, as well as at the meeting of the 163 plenary session, held on 7 October 2014.
