The National Consultative Commission on Collective Agreements (CCNCC) exercises an advisory function, takes decisions in cases foreseen and acts as an observatory of collective bargaining.
Functions
The National Consultative Commission on Collective Agreements is a collegiate, tripartite body, composed of representatives of the General Administration of the State and of the most representative trade union and business organizations, attached to the Ministry of Labour and Social Economy, through the General Directorate of Labour.
The functions of the Commission are set out in Article 3 of Royal Decree 1362/2012, of 17 September, regulating the National Consultative Commission on Collective Agreements:
(a) Advisory functions with regard to the approach and determination of Functional scope of collective agreementsas well as issuance of the mandatory report in the procedures for the extension of a collective agreement established in article 92.2 of the Workers’ Statute.
b) Observatory of collective bargaining, which will include the information, study, documentation and dissemination of the same.
c) Decision-making functions on the resolution of discrepancies arising from lack of agreement in the procedures for non-application of the working conditions provided for in the collective agreement of application in the cases established in Article 82.3 of the Workers’ Statute.
