Non-application procedure

Explanation of the procedure and cases for the non-application of a collective agreement.

What is the non-application of a collective agreement?

When there are economic, technical, organizational or production causes, by agreement between the company and the representatives of the workers legitimated to negotiate a collective agreement, it may proceed, after developing a period of consultations, to inapply in the company the working conditions provided for in the applicable collective agreement, either sector or company, that affect the following matters:

  1. 1.- Jornada de trabajo.
  2. 2.- Horario y distribución del tiempo de trabajo.
  3. 3.- Régimen de trabajo a turnos.
  4. 4.- Sistema de remuneración y cuantía salarial.
  5. 5.- Sistema de trabajo y rendimiento.
  6. 6.- Funciones, cuando excedan de los límites que para la movilidad funcional prevé el artículo 39.
  7. 7.- Mejoras voluntarias de la acción protectora de la Seguridad Social.

When the consultation period ends without agreement and the procedures referred to in article 82.3 of the Workers’ Statute are not applicable or have not resolved the discrepancy, either party may submit the solution of the same to the National Consultative Commission on Collective Agreements when the non-application of the working conditions affects work centers of the company located in the territory of more than one autonomous community, or the corresponding bodies of the autonomous communities in the other cases.
